Leaves and absences are governed by SMSD DEC Local Policy on Leaves and Absences.   Please review these policies:

Family Medical Leave Act (FMLA)

The Family Medical Leave Act is a Federal law passed in 1993.  It gives eligible employees up to twelve (12) work-weeks or 60 days of job-protected unpaid leave for family and medical reasons. 

To be considered for eligibility, you must have completed 1 full calendar year or worked 1,250 hours of service during the previous 12 month period AND submit FML Certification paperwork to document one of the following:
   
*   the birth of a son or a daughter of the employee and in order to care for such son or     daughter
*   the placement of a son or daughter with the employee for adoption or foster care
*   in order to care for the spouse, or a son, daughter, or parent of the employee, if such     spouse, son, daughter, or parent has a serious health condition
*   because of a serious health condition that makes the employee unable to perform the     functions of the position of such employee
*   because of any qualifying exigency arising out of the fact that the spouse, or a son,     daughter, or parent of the employee is on covered active duty (or has been notified of an     impending call or order to covered active duty) in the Armed Forces.

FMLA INFORMATION

YOU MUST BE IN CONTACT WITH YOUR DIRECT SUPERVISOR PRIOR TO INITIATING ANY REQUESTS FOR LEAVE.

"Planned" (non-emergency) procedures requiring FML leave must have the medical certification returned by the physician 2 weeks prior to the absence.  Emergency situations will be handled on a case-by-case basis.

SICK LEAVE BANK


The District shall establish a sick leave bank that employees may join through contribution of local leave.  Requests to join the sick leave bank must be received by the end of business on November 16, 2018.

Leave contributed to the bank shall be solely for the use of participating employees.  An employee who is a member of the bank may request leave from the bank if the employee or a member of the employee's immediate family experiences a catastrophic illness or injury and the employee has exhausted all paid leave.

 

All decisions regarding the sick leave bank may be appealed in accordance with DGBA(LOCAL), beginning with the Superintendent or designee.
